Judge will consider releasing Kilmar Abrego Garcia from jail, possibly leading to his deportation

A federal judge in Tennessee will soon decide whether to release Kilmar Abrego Garcia, a Salvadoran man charged with human smuggling, while he awaits trial. Prosecutors argue that Abrego Garcia poses both a flight risk and a danger to the community. His lawyers say that if released, he could be immediately detained by Immigration and Customs Enforcement and deported, despite a prior court order protecting him from removal to El Salvador due to threats from gang violence. ICE mistakenly deported him in March 2025, but he returned to the United States shortly after, following a Supreme Court order.

Another federal judge in Maryland criticized the Justice Department for not providing clear information about its deportation plans for Abrego Garcia. The judge expressed concern that Abrego Garcia could be removed from the country without a meaningful chance to contest his deportation. His legal team and wife are asking the court to keep him in Maryland while his criminal case continues. They argue that government officials have sent mixed messages, which increases the risk that he could be deported again before he has the chance to fully defend himself in court.
