Judge Orders U.S. to Admit 12,000 Refugees Blocked by Executive Order

A federal judge has ordered the Trump administration to admit approximately 12,000 refugees into the United States, following a legal dispute over the enforcement of an executive order that suspended the refugee admissions program. U.S. District Judge Jamal Whitehead ruled that the administration must process refugees who had been approved for travel to the U.S. before the suspension took effect on January 20, 2025.

The ruling comes after the 9th Circuit Court of Appeals limited an earlier decision by Whitehead but maintained that refugees with “arranged and confirmable” travel plans must still be processed. The Justice Department argued that only 160 refugees met that standard—those scheduled to travel within two weeks of the suspension—but Whitehead rejected this interpretation, stating the government was misreading the appeals court’s order.

Whitehead gave the administration seven days to instruct U.S. agencies and embassies to resume processing the affected refugees and to begin preparations for their entry, provided their security and medical clearances remain valid. The refugee program, established by Congress in 1980, offers legal migration to individuals fleeing war, persecution, or disaster.
